Brazil seeks BRL1 billion in moral damages from 17 betting companies in Pernambuco lawsuit

Brazil’s Attorney General’s Office (AGU) has filed suit against 17 betting companies in the Federal Court of Pernambuco, asking for BRL2.6 billion ($444.3 million) in reimbursement to the public health system and at least BRL1 billion in collective moral damages. For PSPs and operators, the message is simple: Brazil is turning betting-related health costs into a legal claim, and it is doing so against firms that, according to the government, account for about 80% of the market.

  1. The AGU says gambling has increased mental health costs for bettors and argues that operators are privatizing “significant profits” while shifting the budgetary burden of collective illness to Brazil’s Public Health System, SUS, and to society as a whole.
  2. The lawsuit was filed in Pernambuco because the Northeast region has the highest concentration of socioeconomically vulnerable individuals involved in high-risk gambling, according to the government.
  3. Brazil says the statutory allocations paid by betting companies are not enough to cover healthcare costs. Of the mandatory allocations from operators’ revenue, only 0.12% goes to the Ministry of Health, the AGU said.
  4. The claim covers the five years before the lawsuit was filed and would continue as long as the damages recognized by the court persist. The AGU says the exact amount for the health-system reimbursement is not fixed yet and should be calculated later, although the current estimate stands at BRL2.6 billion.
  5. The 17 companies named in the proceedings include Kaizen Gaming Brasil Ltda. (Betano), HS do Brasil Ltda. (Bet365), SPRBT Interactive Brasil Ltda. (Superbet), Ventmear Brazil SA (Sportingbet), Esportes Gaming Brasil Ltda. (Esportes da Sorte and Onabet), Foggo Entertainment Ltda. (Blaze), NSX Brazil (Betnacional), EB Intermediações e Jogos S/A. (Estrelabet), Ana Gaming Brasil SA (7K and Casino), OIG Gaming Brazil Ltda. (7Games and Betão), BPX Bets Sports Group Ltda. (Vaidebet), H2 Licensed Ltda. (H2 Bet), Pixbet Soluções Tecnológicas Ltda. (Pixbet), NVBT Gaming Ltda. (Novibet), SevenX Gaming S/A. (Bullsbet), NSX Betfair Brasil SA (Betfair), and Apollo Operations Ltda. (KTO).

The lawsuit lands in the middle of a turbulent week for Brazil’s betting sector. President Luiz Inácio Lula da Silva announced a ban on the industry last Friday, and from 6 October all licensed sites will be blocked in Brazil. For operators and their payment stacks, that is not just a policy headline; it is a direct question about which brands can keep processing locally and under what legal basis.
