Luiz Fux gives Brazil’s AGU 72 hours to respond to the MP that bans fixed-odds betting
Brazil’s Supreme Federal Court (STF) has put another fast-moving betting case on the clock. Justice Luiz Fux ordered the Attorney-General of the Union (AGU) to respond within 72 hours in ADI 7721, a case that already has Brazil’s new provisional measure (MP nº 1.394/2026) on the table — the one that bans the operation, offering, intermediation, and advertising of fixed-odds betting in the country.
- Fux signed the order on Friday (2), telling the AGU: “Intime-se o Advogado-Geral da União para manifestação no prazo de 72 horas. Publique-se.” For operators and PSPs, the useful part is simple: the STF is moving the challenge on an urgent timetable, not treating the MP as a slow-burn constitutional issue.
- The order came the same day the STF said Fux would be the rapporteur for ADIs 8024, 8027, and 8028, all filed against the MP. They were assigned by prevention because of ADI 7721, under Article 77-B of the Internal Rules, which sends related constitutional actions to the same justice when the subject matter overlaps fully or partly. The case file also lists ADIs 7723 and 7749 as related proceedings under Fux.
- ADI 8024 was filed by the Associação Nacional pela Segurança Jurídica dos Jogos e Apostas (Anseja), which wants the MP suspended in full. Its argument is procedural and familiar to anyone watching Brazil’s betting file: the measure was issued without the constitutional urgency required for a provisional measure and covers matters that, in its view, cannot be regulated that way.
- ADI 8027, filed by the Associação Nacional de Jogos e Loterias (ANJL), also seeks suspension of the MP. It goes further and asks the court to declare the constitutionality of Chapter V of Law No. 13.756/2018 and Law No. 14.790/2023, which together make up the fixed-odds betting framework. ANJL wants an injunction ideally before 5 October, when platforms are supposed to go offline, or at least by 25 October, when federal authorizations are scheduled to expire.
- ADI 8028 was filed on Tuesday (29/9) by the Associação Nacional dos Prefeitos e Vice-Prefeitos da República Federativa do Brasil (ANPV). It also asks for the MP to be suspended in full, but its substantive challenge is different: it disputes whether the betting ban can apply to states and the Federal District.
For the high-risk crowd, the important detail is not just the headline ban. It is that Brazil’s betting framework is now being attacked from multiple angles — procedure, constitutional scope, and the practical shutdown timeline for platforms. On the amicus side, the case has already pulled in Flamengo, Fluminense, Botafogo, Cruzeiro, São Paulo, Ponte Preta, Guarani, Portuguesa, Vitória, and the Associação Brasileira de Emissoras de Rádio e Televisão (Abert). The PDT, meanwhile, asked to join ADI 8024 to defend the ban.
