Between 3 and 10 July 2026, the Brazilian federal government issued three ordinances that redraw advertising rules for fixed-odds betting in Brazil. For high-risk PSPs, the important part is that the new package reaches the full communications chain: operators, digital influencers, media outlets, platforms, and social networks.

  1. The market context is not small. According to Banco Central data cited in the source, betting-related transfers totaled between R$ 18 billion and R$ 21 billion per month in 2024, with about 24 million individuals making PIX transfers to betting companies. That is the backdrop for a tighter advertising framework, not a side note.
  2. The first instrument is Portaria SPA/MF nº 1.964/2026, signed on 3 July by the Secretariat of Prizes and Betting of the Ministry of Finance. It amends Portaria SPA/MF nº 1.231/2024 to create standardized warning phrases and revoke rules on rewards.
  3. The second is Portaria Interministerial MF/SECOM/MJSP nº 73/2026, dated 10 July. It comes from an unprecedented joint move by the Ministry of Finance, the Presidential Secretariat for Social Communication, and the Ministry of Justice and Public Security, and sets consumer-protection rules that apply to the entire advertising chain.
  4. The third is Portaria GAB/SENACON nº 71/2026, also dated 10 July. It creates a Working Group to coordinate enforcement of the betting market through the National Consumer Protection System.
  5. The most visible operational change starts on 17 July 2026: every betting ad must carry one of three standardized warnings — “Ministério da Fazenda adverte: Apostar pode causar dependência”, “Ministério da Fazenda adverte: Apostar faz você perder dinheiro”, or “Ministério da Fazenda adverte: Aposta não é investimento”. The warning must be horizontal, clear, legible, and occupy a specified space in the creative.

The timing matters. The rules arrived during the FIFA World Cup, when betting volumes naturally spike and when sponsorship-heavy sports coverage tends to blur the line between editorial content and betting promotion. The source says those live-broadcast controversies helped trigger SENACON’s investigation and also fed legislative proposals in Brasília. For PSPs, the practical takeaway is simple: the compliance perimeter is no longer limited to the operator’s own landing page or app; it extends to the channels where acquisition actually happens.
