CJEU to rule on Malta’s Bill 55 on 19 November, a law shielding island licensees from EU judgments
The Court of Justice of the European Union is set to decide on 19 November how far Malta’s Bill 55 can go in protecting Maltese licensees from enforcement of European judgments. For high-risk operators and their PSPs, this is one of those rulings that can change the practical value of a Malta licence overnight.
- The case centers on Bill 55, Malta’s law that is described as shielding island licensees from European justice. In plain terms, the issue is whether Maltese courts and operators can keep using the law to resist the effect of judgments coming from other EU jurisdictions.
- The date matters: the CJEU is due to issue its decision on 19 November. That makes this a live jurisdictional risk event for any gambling business, payment provider, or acquiring bank that structures exposure around Malta-facing activity.
- For the industry, the practical question is not abstract legal theory. If the court narrows or upholds the protection, it affects how disputes are enforced against Malta-licensed operators and how comfortable counterparties are with that licence from a payments and risk-management standpoint.
