The Brazilian Institute of Responsible Gaming (IBJR) has endorsed Decree No. 13.033/2026 and Portaria No. 1.766/2026, both published by Brazil’s federal government to tighten action against illegal fixed-odds betting. For PSPs, banks, and advertisers, the important bit is the new responsibility structure: the rules extend liability for tax collection tied to irregular betting operations.

  1. The IBJR said the decree and the portaria are a step toward “asphyxiating and weakening” clandestine operations and said it supports the federal government, along with the Ministry of Finance and the Ministry of Justice and Public Security, for issuing the measures.
  2. According to research by Instituto Locomotiva with LCA Consultoria, Brazil’s illegal betting market currently moves approximately R$ 40 billion a year outside the law and generates an estimated R$ 10.8 billion annual loss to public coffers. For payment companies, that is the kind of number that tends to end up in enforcement discussions sooner rather than later.
  3. The new framework regulates the blocking of funds linked to illegal bets and establishes joint responsibility for financial institutions, payment companies, and advertisers in collecting taxes related to irregular fixed-odds betting.
  4. IBJR said the measure should strengthen public revenue, increase bettor safety, protect operators that comply with Brazilian law, and support the integrity and sustainability of the sector, which it described as operating under one of the world’s most modern regulatory frameworks.
  5. The institute also said it remains committed to working closely with the authorities to develop a betting environment in Brazil that is safe, transparent, and fully regulated.
