Nebraska’s online sports betting referendum is on the November 3 ballot after petition certification

Nebraska voters will decide on November 3 whether the state can expand sports betting to the internet. If both measures pass, the question stops being theoretical: racetrack casinos could enter online betting directly or through partners, and the Nebraska Gaming and Racing Commission would have to build the rules from scratch.

1. The Nebraska Secretary of State’s office certified two initiatives for the general election ballot after determining they had enough valid signatures. One measure would amend the state Constitution; the other would create the legal framework for regulating online sportsbooks. In other words, it is the usual two-step dance: first change the constitutional plumbing, then write the operating rules.
2. The signature thresholds were different. The constitutional initiative needed 138,473 valid signatures, equal to 10% of Nebraska’s registered voters plus the required county-level threshold. The regulatory initiative needed 96,918 signatures statewide. State officials also had to review concerns about authenticity, after more than 13,000 Lancaster County petitions were flagged for potential irregularities, but still concluded the measures qualified.
3. If both questions pass, Nebraska’s existing racetrack casinos could offer online sports betting themselves or partner with sportsbook operators. Each casino would reportedly be allowed to partner with up to two online betting platforms, which is the detail PSPs and acquiring teams usually care about first: who can hold the customer relationship, and how many branded fronts the state will tolerate.
4. Tax Relief Nebraska, the group behind the initiatives, says mobile wagering in the regulated market would keep betting activity and the economic benefits in the state. A study commissioned by the group projected as much as $87 million in tax revenue from online sports betting in the first five years. Under the proposed framework, most of the proceeds would go to the Property Tax Credit Cash Fund.
5. The campaign has also attracted money from major gambling operators. DraftKings and FanDuel have invested millions into the effort, while BetMGM and WarHorse Gaming have also backed it. Supporters point to Nebraskans already crossing state lines to place mobile bets; opponents have raised concerns about gambling-related harm and easier access to betting.

The ballot measures would bar betting on games involving Nebraska college teams, and that restriction would remain even if online sports gambling is approved. Before Election Day, state officials will hold public hearings and provide voters with information on the proposals.
