21 Brazilian football clubs back ADI against Lula’s betting ban as Fux weighs injunction by October 6
Twenty-one football clubs have joined representations in support of an Ação Direta de Inconstitucionalidade (ADI) seeking to overturn the MP signed by President Luiz Inácio Lula da Silva that takes sports betting houses offline. For high-risk payment and gaming operators, the immediate issue is not ideology; it is whether Brazil’s betting-related commercial flow gets cut off, and when.
- According to PVC at UOL Notícias, the club filings increase pressure on Supremo Tribunal Federal (STF) Justice Luiz Fux, who has until Tuesday, October 6, to review the position of the Advocacia-Geral da União (AGU) and decide whether to grant an injunction.
- The view at the end of last week was that the more clubs joined the case, the better the odds of Fux granting interim relief. Twenty-one clubs was treated as a meaningful number in that calculation.
- Under the presidential Medida Provisória, betting houses go offline at 11:59 pm on Monday, October 5. If Fux grants the injunction, the expectation is that it would come on Tuesday, October 6, or Wednesday, October 7, which would add another layer of instability to the sports calendar.
- Without an injunction, Série A teams would already be playing on Wednesday, October 7, with shirts that no longer carry betting brands. Série B matches on Tuesday, October 6, would also be played without those markings.
- The AGU’s preliminary assessment was that the sector’s protection period passed without adequate protection being guaranteed. That is the argument Fux now has to review before deciding.
For operators and PSPs tied to Brazilian sports betting, the practical takeaway is simple: the regulatory clock is moving on a fixed schedule, but a judicial injunction could shift the timeline by a day or two and reopen the question of whether betting-related commercial visibility remains in place for clubs and sponsors.
