Wisconsin Defends Act 247 as BCTA Challenges Tribal Online Sports Betting
Wisconsin has told a court that its new tribal online sports betting law is valid, after the Brown County Taxpayers’ Association (BCTA) sued to block it. For PSPs and operators watching tribal access models, the useful detail is simple: the law is on the books, but the launch question is now tied up in litigation.
- In April, Wisconsin lawmakers approved AB 601, later becoming Act 247, which allows Native American tribes in the state to offer online sports betting. The state had already allowed tribal casino gaming and sports betting, but not online wagering.
- Rep. Tyler August said the move was needed to crack down on illegal alternatives. Governor Tony Evers said the legalization was meant to encourage Wisconsin’s 11 tribes to capitalize on the opportunity and work together to end inequalities among them.
- The BCTA filed suit, arguing that Act 247 gives exclusive benefits to tribe members based purely on race and therefore violates the Wisconsin Constitution. Wisconsin has responded that the lawsuit is baseless, with Assistant Attorney General Colin Roth saying Act 247 is fully legal and does not breach the Constitution.
- Wisconsin’s affirmative defenses say the BCTA fails to state a claim upon which relief can be granted and lacks standing to pursue the case. A scheduling conference is set for next month.
- Separately, the Menominee Indian Tribe of Wisconsin said it revised the site plan for its proposed casino project in Kenosha. The new plan consolidates parking into a smaller area, reducing the amount of agricultural land used, after feedback from the federal review process.
For high-risk payment teams, the headline issue here is not just tribal gaming policy in Wisconsin; it is whether the legal framework for online wagering survives the current challenge. Until that is settled, any commercial planning around launch timing, onboarding, and acquiring support remains conditional on the court process.
