TRF-3 suspends Brazil’s MP 1.394 against CDA Gaming, clearing Betsul and Casa de Apostas to return

A federal appeals court in Brazil has provisionally restored CDA Gaming’s licence, allowing Betsul, Casa de Apostas and Jogo Online to resume operations while the case remains pending. For PSPs and acquirers, the important bit is that the court also ordered the restoration of the operational, financial and payment services the company needs to keep running.

  1. Federal Appellate Judge Adriana Pileggi of the 3rd Panel of the Regional Federal Court of the 3rd Region (TRF-3) suspended the effects of Provisional Measure (MP) 1.394 on CDA Gaming Ltda. The judge said the sudden termination of authorisations breached the constitutional principles of legal certainty, reasonableness and proportionality.
  2. The ruling means CDA Gaming’s three brands — Betsul, Casa de Apostas and Jogo Online — may return to the Brazilian market until a final judgment is reached in the case.
  3. MP 1.394 had prohibited betting operations and cut short authorisations granted under Brazil’s regulated market. CDA Gaming received its licence from the Secretariat for Prizes and Betting (SPA) in February 2025, with SPA/MF Ordinance 255/2025 authorising it to operate all three brands.
  4. Pileggi also criticised the justification behind MP 1.394, which cited protection of public health, consumers, children, adolescents and families. In her words, if that were the case, the measure “would be a miracle” and “obviously, such an approach is unacceptable from a legal standpoint”.
  5. As of 4pm Brazilian time on Wednesday (7pm UK), iGaming Business observed that only the Casa de Apostas website had come back online. Betsul’s site displayed a notice saying its operations had been restored under the court decision, but it was not yet functional. Jogo Online was still redirecting to the brasilsembets website.
