Sports betting operators in Brazil are facing a legal headache that could spill into pricing and market design: players are already getting injunctions against platforms that use their names in bets tied to individual performance. The immediate issue is not just image rights, but whether courts start treating these bets as a category that can be shut down.

  1. According to Coluna Guilherme Amado on AmadoMundo, sportsbook companies operating in Brazil fear a flood of lawsuits from football players after injunctions were granted to Ricardo Bueno, Guilherme Marques, Gabriel Barros, and Gustavo Vilar.
  2. The orders already affect platforms including Betano, Bet365, Verabet, and Cassino Bet, and prohibit bets linked to individual player performance. The banned markets include goals, cards, and fouls.
  3. The legal theory behind the cases was developed by lawyer Marcelo Robalinho. His argument is that using an athlete’s image as a commercial product without consent is exploitive, and that it also exposes players to abuse and threats from frustrated bettors on social media.
  4. The thing operators are now worried about is precedent. The sector’s concern is that these decisions could become case law and effectively close off the individual betting segment in Brazil.
  5. There is also a compliance angle. The operators did not follow the orders to remove the players’ names from the websites, and the resistance is reportedly aligned with instructions from the platforms’ international parent companies. The players’ defense team is now pushing for daily fines and is considering asking for access to the platforms to be blocked in Brazil.
