Azerbaijan is preparing prison terms of up to 5 years for online gambling organizers

The Milli Majlis is reviewing amendments to the Criminal Code that would treat online casino and sportsbook operations as a separate enforcement target, with prison terms, income-linked fines, and explicit coverage of digital channels. For PSPs and acquirers, the important part is not the headline penalty alone; it is the shift from blocking websites to scrutinizing the payment flow behind them.

  1. The draft introduces a base penalty of 2-4 years of restricted freedom or imprisonment for launching gambling through digital channels, including websites, apps, and mobile networks.
  2. The same 2-4 year range would apply if minors are involved, if the activity is carried out by a group of people, or if significant income is recorded.
  3. For organized groups with large income, the proposed punishment rises to 3-5 years of imprisonment.
  4. The current fixed-fine approach is being removed. Instead, the penalty would be tied to income and could reach twice the amount of illegal profit, which means the size of the business becomes part of the sentence.
  5. In practical terms, the draft shifts the focus onto infrastructure: authorities are targeting the operators of online gambling platforms rather than casual participants, and that puts banks and local payment providers closer to the compliance front line.

For high-risk payment flows, the mechanism matters here. If penalties are linked to revenue, transaction records stop being a back-office detail and become evidence. That usually means tighter due diligence, deeper historic transaction reviews, and less room for casual processing of gambling-related merchants.
