Flamengo asks Brazil’s Supreme Court for urgent ruling on Bets MP before October 6
The Club de Regatas do Flamengo has asked Justice Luiz Fux for an immediate decision on the injunction request in ADI 8.027, arguing that the clock is about to run out on Provisional Measure No. 1.394/2026. For PSPs and sportsbooks, the point is simple: the court fight is now tied to an enforcement deadline that could force site blocking, ad takedowns, and sponsor visibility restrictions within hours.
- In a petition filed on Saturday, October 3, Flamengo asked the Supreme Federal Court to examine the preliminary injunction “with the utmost urgency and, in any case, before 11:59 p.m. on October 5,” including through a single-justice decision subject to later review by the full court. Flamengo was admitted as amicus curiae on September 30.
- The club wants the MP’s effect suspended until either Congress finishes reviewing it or the merits of the case are decided, whichever happens first. The challenge was brought by the Associação Nacional de Jogos e Loterias (ANJL) against MP No. 1.394/2026.
- Flamengo says the MP’s 10-day deadline, counted from publication on September 25, expires at 11:59 p.m. on Monday, October 5. That is the deadline the club points to for operators to disable websites and apps under article 7, and to remove all advertising material and sponsorship signs under article 16, paragraph 2.
- From midnight on Tuesday, October 6, Flamengo argues, showing a sponsor’s brand “on the shirt, on stadium boards and LED panels, in training centers, gyms and media channels” would be treated as abusive advertising and could trigger sanctions under article 56 of Brazil’s Consumer Defense Code. The club cites a BNLData report saying the Ministry of Finance’s Secretariat of Prizes and Betting has already notified licensed platforms to redirect all traffic to the federal government’s official page from 0:01 a.m. on October 6.
- The filing also argues that Congress will not move fast enough to prevent the measure from taking effect. Flamengo notes that the joint committee was only set up on September 30, amendments have been extended to October 13 and now total 40, the urgency procedure starts only on November 9, and the MP’s initial validity period ends on November 23. The club says the ordinary route under article 12 of Law No. 9.868/1999 would take longer than the time left.
For high-risk operators, the practical issue here is not abstract constitutional theory. It is whether Brazil’s betting restrictions begin to bite on a hard timetable that affects traffic redirection, affiliate material, sponsorship visibility, and the operational value of existing commercial deals.
