Brazil gives fixed-odds betting operators three business days to report player balances, sets December 15 as the shutdown deadline

Brazil’s Ministry of Finance has set out the transition rules for fixed-odds betting operators whose authorizations will be extinguished under MP 1.394. The practical point for PSPs and operators: player balances must be reported fast, but the rule does not set a date for when the money has to reach the bettor.

  1. The Secretaria de Prêmios e Apostas (SPA/MF) published Portaria SPA/MF nº 3.005 in an extra edition of the Diario Oficial da União on Friday (2). The regulation was signed by Secretary Daniele Correa Cardoso and entered into force on the date of publication.
  2. The portaria creates two key deadlines. First, operators must calculate the final balances of bettors’ wallets at 23h59min59s on Monday (5) and send the information to the SPA by Wednesday (7). Second, 15 de dezembro de 2026 is the final date for full compliance with the regulatory, monetary, registration, accounting and information obligations under the MP.
  3. For the refund process, operators must send the SPA, through the Sistema de Gestão de Apostas (SIGAP), the final balances of bettors’ wallets and the balance of the transactional account used to move betting funds. The submission must identify the financial or payment institution holding the transactional account, the operator’s CNPJ, and the brands used. For each bettor, the company must provide CPF, date of birth, amount to be refunded, and destination account details: institution code, branch, and account number.
  4. The portaria also requires operators to tell the SPA the date on which they sent the financial or payment institution the information needed to execute the refund. The data must be submitted only in the formats and structures defined by the SPA, to be made available on its website. Between publication and the submission deadline, there are three business days.
  5. What the rule does not do is just as important for payments teams. It sets the reporting obligation, but not the deadline for funds to be actually credited to bettors. It also does not address open bets on events after October 5, bonus balances, bettors without a registered bank account, unclaimed amounts, or the handling, retention, and deletion of the personal and banking data handed over to the Secretariat.

By 15 de dezembro, operators must also finish the calculation, issue the payment slips, and collect all amounts due to the legal recipients listed in Law No. 13.756/2018, based on revenue generated up to the final date for taking bets. They must also report amounts calculated, collected, and not collected, and respond to SPA notices and requests.
