Widow Tells High Court Betfair Sent Rewards Email to Deceased Gambler After His Death

The High Court has heard that Betfair sent a promotional email to Luke Ashton after he died, with the message allegedly prompting him to log in and claim rewards. For high-risk operators, the case is a reminder that post-death account communications and responsible gambling controls can become part of a negligence argument very quickly.

  1. Annie Ashton, the widow of 40-year-old Luke Ashton from Leicester, said she found the email while reviewing his email account after his death. The message allegedly urged him to log into his account to access rewards.
  2. Luke Ashton died on April 22, 2021. A coroner concluded that a gambling disorder was a contributing factor in his death, and Annie Ashton is now bringing legal action against TSE Malta, the company that operates Betfair in the United Kingdom.
  3. In her witness statement, Annie Ashton said the “vast majority” of her husband’s gambling activity in the final years of his life took place through Betfair. She also said that when she checked his mobile phone after his death, Betfair was the only gambling-related app installed.
  4. Betfair is contesting the case. Its lawyers argue that the company did not owe Luke Ashton a legal duty of care and that its responsible gambling measures were properly applied. The company also says Ashton used other operators and faced pressures unrelated to gambling, including work, finances, and personal well-being.
  5. The trial is expected to continue until June 19. It is being closely watched because the court’s findings could affect how gambling companies monitor customers showing signs of addiction and how far their duties extend when an account remains active after death.

The case sits in the uncomfortable space where customer communications, account monitoring, and responsible gambling controls meet liability exposure. For operators and PSPs in high-risk verticals, the practical question is not just whether the right tools exist, but whether they keep firing at the wrong time.
