Kalshi files federal lawsuit to block Louisiana gambling enforcement over prediction markets
Kalshi has gone to federal court in Louisiana to stop the state from applying its gambling laws to sports event contracts on the platform. For high-risk payment businesses, the point is simple: if a state treats a product as illegal gambling while the operator says it falls under federal commodities regulation, the fight quickly becomes a licensing and enforcement problem.
- Kalshi filed the lawsuit on October 23, 2026, in the US District Court for the Western District of Louisiana. The company is asking for a temporary restraining order, plus preliminary and permanent injunctions, to prevent what it says could be imminent enforcement action by the state.
- The dispute centers on House Bill 53 and House Bill 883, which were signed into law in May and took effect on August 1, 2026. Kalshi says Louisiana has designated sports event contracts as illegal gambling and is trying to use those laws against prediction market platforms.
- Kalshi’s complaint argues that Louisiana does not have authority under its statutes to regulate what it describes as a federal matter. The company is relying on the Commodity Exchange Act (CEA) and its regulation by the Commodity Futures Trading Commission (CFTC) to argue that Louisiana’s licensing requirements are incompatible with the federal framework.
- This is the first time the case will be handled under the jurisdiction of the U.S. Court of Appeals for the Fifth Circuit. That matters because the venue now sits inside a circuit that will shape how the court views the conflict between state gambling rules and federally regulated event contracts.
- Louisiana says the laws were meant to target unauthorized online casinos, sportsbooks, and sweepstakes platforms. Kalshi’s position is that the wording is broad enough to reach its operations anyway, which is why it is pushing for court intervention before any enforcement action is formally announced.
