Peru’s Mincetur proposes tighter rules for online betting and remote gaming operators

Peru’s Mincetur proposes tighter rules for online betting and remote gaming operators

The Peruvian Ministry of Foreign Trade and Tourism (Mincetur) has published a draft supreme decree to amend the regulations under Law No. 31557, which governs remote gaming and remote sports betting. For licensed operators, the point is not just more paperwork: the proposal is aimed at making obligations, prohibitions, supervision, and sanctions more explicit.

  1. Mincetur authorized the draft through Ministerial Resolution No. 382-2026-MINCETUR. The proposal would modify the rules approved by Supreme Decree No. 005-2023-MINCETUR, with the stated goal of improving clarity and predictability for authorized operators by defining their obligations and prohibitions more precisely.
  2. The draft and its explanatory memorandum will be open for 15 calendar days for comments from public and private entities, civil society organizations, and interested citizens. In other words, the regulatory text is not final yet, but the direction is clear: Peru wants a tighter operating framework for the sector.
  3. One of the main changes is a stronger supervision and enforcement framework for Mincetur. The proposal would adjust rules on information transmission, audits, guarantees, and the conditions required to obtain and keep the relevant authorizations, which matters directly for platforms running remote gaming and remote sports betting operations.
  4. The draft also expressly regulates procedures for declaring confiscated assets abandoned, along with the conditions for their disposal and destruction. That is the kind of operational detail that matters when regulators move from broad licensing language to actual enforcement mechanics.
  5. Another central point is the introduction of objective criteria for grading and imposing monetary penalties on operators. Mincetur says this is meant to make enforcement more coherent, proportional, and effective, while also strengthening user protection, combating illegal gambling, and safeguarding the public interest.

Comments can be submitted through Mincetur’s institutional portal, in person at its office at Calle Uno Oeste No. 050, urbanización Córpac, San Isidro, Lima, or by email to apuestasdeportivas@mincetur.gob.pe. The General Directorate of Casino Games and Slot Machines, under the Vice Ministry of Tourism, will receive, organize, and analyze the feedback during the consultation period.
