Nebraska Voters to Decide Mobile Sports Betting on November 3 After $22.5 Million Campaign

Nebraska Voters to Decide Mobile Sports Betting on November 3 After $22.5 Million Campaign

Nebraska will vote on November 3 on whether to legalize statewide mobile sports betting, with more than $22.5 million already spent to shape the result. For payment providers and sportsbook operators, the real question is not the ballot language itself but whether Nebraska opens a regulated online market with a 20% tax, a college wagering ban, and up to 12 potential operator slots.

  1. DraftKings and FanDuel have been the main funders of Tax Relief Nebraska, which is backing two related ballot measures. Each has contributed about $10.4 million, and the campaign finance disclosures show both companies kept adding money in October as Election Day approached, according to Covers.
  2. FanDuel and DraftKings each added $3.5 million in September, bringing their totals to about $14 million at that point. DraftKings then contributed another $2.5 million on October 13, while FanDuel added the same amount on October 22. The two companies also put in another $750,000 combined. Fanatics has donated a total of $600,000, and BetMGM previously gave $500,000.
  3. Tax Relief Nebraska has spent approximately $15.8 million on the campaign, including more than $5 million on television advertising and other promotional activity. The ballot measures are Initiative 440 and Initiative 441, and both must pass for Nebraska to get statewide mobile sports betting.
  4. Initiative 440 would amend the state constitution to let the legislature authorize online sports betting. Initiative 441 would create the regulatory framework. Under the proposed setup, each of Nebraska’s six regulated gaming facilities, existing or planned, could partner with up to two online sportsbook platforms, which would allow as many as 12 operators if the market fills out that far.
  5. The proposal would impose a 20% tax on gross gaming revenues, with 70% of the tax revenue going to property tax relief. If voters approve the measures, the constitutional changes would take effect on January 1, 2027, and the Nebraska Racing and Gaming Commission would have until June 1, 2027, to write the rules, potentially allowing sportsbooks to launch later that year. Earlier industry estimates put first-year market gross gaming revenue at about $86.6 million, though those estimates depend on actual betting activity and do not guarantee tax intake.

For high-risk PSPs, Nebraska is the kind of market that matters because it is structured around regulated operator partnerships rather than an open free-for-all. DraftKings, FanDuel, BetMGM, Fanatics, Caesars, bet365 and theScore Bet are all names to watch if the measures pass, and the rules will determine how many MIDs and payment flows actually get allocated once the state writes the framework.
