Seminole Tribe sues DraftKings over prediction market, says it is an illegal sportsbook in Florida and seeks an injunction and disgorgement of profits

The Seminole Tribe has filed a lawsuit against DraftKings, arguing that its prediction market amounts to an illegal sportsbook in Florida. For high-risk operators and PSPs, the important part is not the headline drama but the legal theory: when a product starts looking like wagering on sports outcomes, tribal and state-facing risk stops being abstract very quickly.

  1. The tribe wants more than a declaration. It is seeking an injunction and disgorgement of profits, which means the dispute is not just about whether DraftKings can keep running the product, but whether revenue already generated from it should be taken off the table.
  2. The core allegation is that DraftKings’ prediction market functions as a sports betting product in Florida. That matters because the label on the product is not always the label that regulators, tribes, or courts will accept once the mechanics are examined.
  3. This is the kind of case that PSPs, acquirers, and banking partners watch closely. If a court accepts the argument that a prediction market is effectively an unlicensed sportsbook, the payment stack around similar products becomes part of the risk conversation immediately.
