None of the 19 betting lawsuits against Brazil’s MP has an active injunction in Federal Court

One month after Provisional Measure No. 1.394/2026 banned fixed-odds betting in Brazil, operators are still without a live court order keeping them open. A review of 19 cases in the TRF1 and TRF3 systems shows three injunctions denied, one overturned, two cases dismissed, three competency challenges, and the ANJL collective writ of mandamus suspended pending the Supreme Federal Court (STF).

  1. The legal picture matters because the authorizations granted by the Secretariat of Prizes and Bets (SPA/MF) expired on Sunday (25), the day of the second round of the elections. Since then, companies that were trying to secure individual relief in first instance courts until the STF rules have been left without that protection.
  2. The main industry case at first instance is the collective writ of mandamus filed by the ANJL (case 1114596-86.2026.4.01.3400). On 22 October, the 21st Federal Civil Court of the Federal District ordered the case suspended until the STF hears ADI 8024, and that decision was published on Monday (26). ADI 8024 is among the concentrated constitutional review actions against the MP and was assigned by prevention to Justice Luiz Fux, who also reports ADIs 8027 and 8028.
  3. With the stay in place, the industry-wide case now depends entirely on the Supreme Court. Fux had signaled that he would decide after the second round, so the collective route is on hold rather than producing any operational relief.
  4. The TRF1 docket produced a mixed but mostly unfavorable result set: Futuras Apostas (1114566-51.2026.4.01.3400) was dismissed without resolution on the merits on 8 October, with the 21st Federal Civil Court of the DF denying the writ for lack of procedural conditions; BPX Bets Sports Group (1115351-13.2026.4.01.3400) was declared outside the court’s competence on 22 October and then redistributed by dependence, with the file ready for a ruling since 23 October; Logame do Brasil (1109459-26.2026.4.01.3400) remains pending in the 17th Federal Civil Court of the DF with no decision yet; and Filipe Matias Barbosa Ramos (1109428-06.2026.4.01.3400), a popular action against President Luiz Inácio Lula da Silva and others, is still at the service-of-process stage with no recent ruling.
  5. In the Federal Court in São Paulo, the result is even worse for operators: the only injunction so far was the one obtained by Stake Brazil (5030862-66.2026.4.03.6100), and that injunction was later overturned. In other words, the sector has not secured any standing judicial protection to bridge the gap between the MP and the STF.
