Stake Brasil wins temporary court relief to keep its betting site active until 25 October 2026

Stake Brasil has secured partial preliminary relief from a federal court in São Paulo, letting its licensed fixed-odds betting operation continue under the court’s terms until 25 October 2026. For PSPs and acquiring teams, the useful part is not the headline drama; it is that the order temporarily limits blocking, redirection, and enforcement measures tied to Provisional Measure No. 1,394/2026.

  1. The decision was reported on 8 October 2026 by the 9th Federal Civil Court of São Paulo and concerns the authorisation held by Stake Brazil Ltda. under Portaria SPA/MF No. 263/2025.
  2. Under the order, that authorisation keeps provisional effect until 25 October 2026, or until a later judicial decision, whichever comes first. The court also directed the relevant authorities not to treat the authorisation as automatically extinguished before that date.
  3. The relief is tied to the immediate impact of Provisional Measure No. 1,394/2026, which introduced a nationwide prohibition on the operation, offering, intermediation and advertising of fixed-odds betting in Brazil. The court’s order does not cancel that framework; it only carves out temporary protection for this specific operator and this specific authorisation.
  4. One of the practical points is the stake.bet.br domain. The order temporarily suspends blocking, redirection or unavailability measures affecting the domain, related applications and technological infrastructure covered by the authorisation when those measures are based exclusively on bringing forward the authorisation’s expiry.
  5. The court also restricted sanctions solely because the company continues operating within the limits set by the order. That matters because the ruling preserves a defined operating window, but it does not create a general exemption for other betting companies or a broader suspension of the federal government’s rules.

The court was explicit about the scope: this is temporary relief, not a final ruling on the validity of Provisional Measure No. 1,394/2026. For high-risk payment flows, that means Brazil remains a jurisdiction where the legal status of a licensed betting merchant can move faster than the operational stack built around it.
