Boca Juniors shirt sponsor Betsson puts Brazil’s betting ad ban under legal scrutiny at the Maracanã
Boca Juniors took the pitch at the Maracanã on Tuesday night with Betsson on the front of its shirt, and the 3-1 win over Vasco da Gama that sent the Argentine club to the Copa Sudamericana final also turned into a useful stress test for Brazil’s betting advertising rules. The issue for PSPs and operators is simple: if the brand is visible in Brazil, local law may treat it as advertising, even when the sponsorship contract was signed abroad.
- The display happened on 20/10 during Boca Juniors’ 3-1 victory over Vasco da Gama in Rio de Janeiro. The shirt carried the Betsson logo in the main sponsor position, and the match was played at the Maracanã, which means the exposure was not some obscure digital asset hidden in a side market.
- According to Exame, the arrangement is potentially illegal in Brazil under Medida Provisória nº 1.394/2026, issued by the federal government on 25 September. The text prohibits any form of advertising or sponsorship for fixed-odds betting in Brazilian territory, and it does not carve out exceptions for foreign clubs playing international tournaments in the country.
- Eduardo Carlezzo, a sports law specialist and partner at Carlezzo Advogados, said the contract’s foreign origin does not change the legal analysis: the decisive point is that the brand was displayed in Brazil and seen by a Brazilian audience. In his reading, the MP treats this kind of exposure as abusive advertising, which can trigger sanctions under Brazil’s Consumer Protection Code, especially administrative fines.
- Sports law specialists cited in the report say the liability may extend beyond the visiting club. Because the brand appeared in a televised event, the exposure can be treated as abusive advertising, with penalties that include fines and suspension of commercial image broadcasts. Depending on each party’s role in the match’s commercial setup, civil and administrative responsibility may also be shared by the host club and the broadcasters generating the images.
- Bernardo Freire Cavalcanti, partner at Betlaw, said the restriction does more than block a single ad: it creates legal uncertainty for international contracts, forces Conmebol to redesign commercial deliveries, and produces a clash between a unilateral Brazilian decision and commercial relationships lawfully signed in other countries. In practice, that is the sort of problem that quickly moves from courtroom theory to sponsorship inventory.
The core point for high-risk operators and their payment partners is jurisdiction. Brazil may not have extraterritorial power to cancel a sponsorship signed in Argentina, but any sports entity operating inside Brazil is subject to local law while it is there. For cross-border betting brands, that makes shirt inventory, broadcast exposure, and event hosting in Brazil a regulatory issue, not just a marketing one.
