Stake Brasil keeps its Brazil betting licence alive under São Paulo court order
Stake Brasil has secured a provisional injunction from the 9th Federal Civil Court of São Paulo that preserves its fixed-odds betting authorisation in Brazil and stops the website stake.bet.br from being blocked or redirected. For PSPs and high-risk operators, the practical point is simple: the court has temporarily kept one licensed route open while Provisional Measure 1,394/2026 is still in play.
- The ruling provisionally preserves the effects of Stake Brasil’s authorisation to operate fixed-odds betting in Brazil. It remains effective until 25 October 2026, and Stake Brasil says sanctions cannot be imposed on the company for operating within the conditions established by the court.
- The company said this is the first time, to its knowledge, that a licensed operator has obtained a decision of this kind. That matters because it gives the market a judicial reference point for how authorisations may be treated while the regulatory framework is being tested in court.
- Under the court order, Stake Brasil’s website at
stake.bet.brcannot be blocked or redirected. In other words, the operator keeps its public-facing channel intact, which is the bit that usually turns legal theory into revenue recognition. - Stake Brasil framed the ruling as a signal of legal certainty for businesses that obtained government authorisation, paid the applicable authorisation fees, and invested in the regulated market. The company also said it has complied with the obligations imposed since the publication of the Provisional Measure.
- The company singled out consumer protection as a core benefit of a regulated betting market, pointing to clear rules, responsible gambling mechanisms, and oversight by public authorities. That is the regulatory argument here: if the operator followed the process, the process should not be rewritten midstream without judicial scrutiny.
For the Brazil market, this is less about a press-friendly legal win and more about whether a licensed operator can keep operating while the rules are being contested. For anyone underwriting payments in high-risk verticals, that is exactly the sort of detail that affects whether a merchant stays on board, gets ring-fenced, or gets shut out.
