Brazil Court Lets Stake Keep Operating Until October 25 as Betting Rule Fight Continues

A São Paulo court has allowed Stake to keep operating in Brazil on a temporary basis, giving fixed-odds operators a short runway while the legal fight over Provisional Measure No. 1,394/2026 plays out. For PSPs and acquirers, the point is simple: Brazil is not giving the market a clean yes or no yet, which means merchant risk is still being decided in court.

  1. São Paulo’s 9th Federal Civil Court granted Stake provisional authorization to continue operating until October 25, 2026, unless an earlier ruling changes the picture.
  2. The decision came after the signing of Provisional Measure No. 1,394/2026 by President Luiz Inácio Lula da Silva on September 25, which created uncertainty for fixed-odds betting operators.
  3. The court said Stake may remain active on a provisional basis as long as it meets bettor-protection requirements and regulatory controls. It also blocked blocks and redirections based only on the expected early expiration of the company’s authorization.
  4. Federal Judge Cristiane Farias Rodrigues dos Santos rejected Stake’s requests to overturn the provisional measure and extend its authorization until 2029, so the ruling is temporary rather than a final settlement.
  5. The case, supported by Bichara e Motta Advogados, is described by the company’s legal team as the first favorable ruling for a fixed-odds betting operator in Brazil in disputes tied to the new provisional measure.

The broader issue is still open. Provisional Measure No. 1,394/2026 is being challenged before Brazil’s Supreme Federal Court (STF), and it also needs approval from the National Congress to become definitive law. Until those pieces move, operators and payment providers in Brazil are dealing with a market where the regulatory basis can change before the settlement cycle does.
